Purpose and content of the course

Course Objectives: In this course, the scope of international humanitarian law (law of armed conflict), which is one of the most technical areas of international law, its historical development, the rights it guarantees, the responsibilities it imposes on the parties, its written sources, practices and basic principles will be taught. It will be examined how these concepts and basic legal principles are codified, especially in the Geneva Conventions, which are the main regulatory agreement of international humanitarian law, how they are applied in international armed conflicts and non-international armed conflicts, which articles provide to whom and what kind of rights and responsibilities will be determined. As a result, it is aimed that the students understand these principles and norms by evaluating them according to the articles within the scope of the contract.
Course Objective: The aim of the course is to help students acquire the ability to understand the purpose of international humanitarian law, the safeguards it provides, and the main sources; to gain the ability to explain the principles and norms in this field using legal concepts.

  1) At the end of this course, students will be able to define international humanitarian law correctly.
  2) They can interpret the main sources according to the cases they have studied.
  3) Using this basic knowledge they learned, they can analyze international and non-international armed conflicts.
  4) They can evaluate which principles, norms, contractual articles and practices are violated in armed conflicts by discussing with legal arguments.

2) Just War and the Law of War. The legitimacy of war. Justifications. Fundamental principles of international and non-international armed conflicts.
3) Basic Principles of Humanitarian Law. Distinction. Military Necessity. Proportionality.
4) Principle of Humane Treatment. Right to a Fair Trial. International Criminal Law Regulation. Important Cases.
5) Protection of Cultural Heritage. Definition of cultural property. Tangible and intangible cultural assets. Basic regulations. Violations.
6) Legal Status Issue in Civil Wars. Legal Status in International Conflicts. Legal Status in Non-International Conflicts. Direct Participation in Hostilities.
7) War Crimes and International Criminal Law. Criminal Law Concept. What It Has in Common with Humanitarian Law. Sources of International Criminal Law. International Criminal Courts.

9) Postmodern Warfare, Technology, and Targeted-Killing. The new meaning of war in the 21st century. New war and defense technologies. Targeted-killing within the context of law and military ops.
